LEGAL TERMS

Agreement. If you use our services these Legal Terms apply. If you do not agree to these Legal Terms, you must not use our services. You can use our services only if you can lawfully enter into an agreement to these Legal Terms under applicable law. If you use our services, you agree to do so in compliance with these Legal Terms and with applicable laws and regulations.

Our Services Bitinsist. Bitinsist provides a way to use and buy and spend bitcoins, using our wallet service, purchasing and mining menu. Our services may evolve over time. This means we may make changes, replace, or discontinue (temporarily or permanently) our services at any time for any reason with or without notice. In this case, you may be prevented from accessing or using our services. If, in our sole discretion, we decide to permanently discontinue our services, we will provide you with notice via our website. Additional services include the following:

Buy Bitcoins. To purchase bitcoins with Bitinsist, simply click on the BUY BITCOINS button after logging in to our web page or app. You will be taken through a process and displays different methods to pay for the bitcoin. Bitinsist charges a fee of 1%. Also, processing fees may apply depending on the payment method and exchange circumstances. The price level at which we sell bitcoins to our customers is the price listed on the site as Current Price. You are solely responsible for ensuring the accuracy of the information included when you initiate your wire. This includes the account number, bank routing number, your Bitinsist reference number and any other information requested by us. Bitinsist cannot revoke or cancel a wire once it has been initiated by your bank. Bitinsist reserves the right to delay or not process incoming wires for any reason, including to verify that the wire was actually initiated by you and where required or recommended by applicable governmental, regulatory or law enforcement requirements. Bitinsist is not liable for any act, omission, mistake, default, delay, negligence, misconduct or insolvency of any third party, including any bank, entity or person.

Bitinsist Cloud Mining. Bitinsist provides lifetime contracts. Lifetime contracts do not have a maturity date. As long as the contract is profitable and the payout covers the maintenance fee you will continue to mine and be able to receive payouts. This could be 100 years, however practically it will depend on difficulty and market prices for the crypto currencies. Our service uses our partner's devices with their permittance.You get daily payouts. As soon as we receive your payment your contract will be added and you can immediately start mining. You mine Bitcoin and can upgrade your hashpower at any time. After the end of the day, you will get your first payout within 24 hours and from then on each following day. It will take up to 48 hours to get your first payment. After that it should take about 24 hours for each payments, but please note that this can vary from day to day. We deduct maintanence fee.The maintenance fee covers all costs related to mining including electricity cost, cooling, maintenance work, hosting services.Maintenance fee may vary from time to time. It is calculated per MH/s GH/s TH/s and automatically deducted on a daily basis. The cost of 1 TH is 256$ at this time. You can pay by bank wire in USD and EUR, with bitcoins and soon with credit card.

Bitinsist Debit Card. The Bitinsist Debit Card allows users to transact with merchants who accept debit cards issued by Mastercard that is shown on the card. If you order and activate a Bitinsist Debit Card, you can handle it directly from your wallet. After filling up your card with the desired amount, this amount will be withdrawn from your wallet in bitcoins at the current price and the merchant will receive payment in their own currency directly from your debit card. The terms of the card program manager and Mastercard, presented at the time you order your card, apply to the Bitinsist Debit Card.

Bitinsist Webshop. The Bitinsist Webshop can be used without registration to our web page. The seller of the products purchased in Bitinsist Webshop is Bitinsist Financial Ltd., Global Gateway 8, Rue de la Perle, Providence, Mahe, The Seychelles. You can purchase the products only with bitcoins. The images of the Products on our web page are for illustrative purposes only. Although we have made every effort to display the products accurately, we cannot guarantee that your computer's display of the Products accurately reflects the Products. Your Products may vary slightly from those images.

The Products listed on our site may vary from time to time, it is your responsibility to check that the description and other information and documents provided reflect the products you wish to purchase. The packaging of the Products may vary from that shown on images on our web page. You confirm that you have authority to bind any business on whose behalf you use our web page to purchase Products. Our webshop menu will guide you through the steps you need to take to place an order with us but it is simple and easy to use. Our order process allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order everytime. When placing an order you are responsible for accurately identifying the Products, product details, pack sizes, expiry dates, quantities and delivery address required.
After you place an order, you will receive an e-mail from us acknowledging that we have received your order and we confirm that your order is accepted or not, then later we send you an other e-mail that confirms that the Products have been despatched (Despatch Confirmation). The Contract between us will only be formed when we send you the Despatch Confirmation. Despatch Confirmation and dispatch strictly only after you paid the products. If we are unable to supply you with a Product, for example because that Product is not in stock or no longer available or because we cannot meet your requested delivery date or because of an error in the price on our site we will inform you of this by e-mail and we will not process your order. If you have already paid for the Products, we will refund you the amount. The minimum order value is one product excluding delivery.
The price payable by you will be our list price at the date of despatch. Our list prices are quoted exclusive of any tax or duty and you shall pay any applicable tax or duty in addition to the price. The price of a Product does not include delivery charges. Our delivery charges are as advised to you shown in the FAQs on our site and will be confirmed in the order confirmation email.
Occasionally our delivery to you may be affected by an event out of our control. We are not responsible for these events at all. The estimated delivery date we provide to you is an estimate only and failure to deliver on that date shall not be a breach of a purchasing contract by us. We will use reasonable endeavours to deliver on the estimated delivery date or within a reasonable time thereafter to the address nominated by you during the order process (delivery address).
If we are unable to deliver an order in full we will, at our option refund any payment made by you in respect of the undelivered quantity or invoice you only for the delivered quantity or deliver any balance at a later date and the Contract between us shall be deemed amended accordingly. Delivery of an Order shall be completed when the delivery note, drop sheet or courier proof of delivery is signed by a person present at the delivery address
Risk in the Products shall pass to you on delivery. Ownership of the Products shall not pass to you until you have paid to us and received the product.
We may issue an invoice to you by email at any time following our acceptance of your order.
Some of the Products we sell to you come with a manufacturer's guarantee. For details of the applicable terms and conditions, please refer to the manufacturer's guarantee provided with the Products. This warranty does not apply to any defect in the Products arising from fair wear and tear or wilful damage, abnormal storage or working conditions, accident, negligence by you or by any third party or if you fail to store, operate or use the Products in accordance with instructionsor any alteration or repair by you or by a third party who is not one of our authorised repairers or any specification provided by you.
On delivery you will inspect the Products and notify us within 12 hours from delivery time of any defect in the Products or deviation from the ordered quantity, description, strength and pack size. Failure to notify us within this 12 hours period shall constitute your acceptance that the Products delivered are delivered. You may return products to us.
In reselling the products you will comply with all applicable laws and regulations, including but not limited to laws relating to consumer protection. You will on demand indemnify us and hold us harmless, on an after tax basis, against any loss we suffer due to your resale of the Products.
Bitinsist Paid Services. Bitinsist provides certain premium services as part of our services for which a fee is charged. The fees described below apply in connection with the following services:

Fees For Buying Bitcoins. As indicated in “Buy Bitcoins”.

Bitinsist Debit Card Fees. If you order a debit card, you will be charged a one-time issuance fee, which will be debited from your wallet in bitcoins. Other fees will depend on your usage of the card: there are third party fees and fees applied by Bitinsist for lost card replacement, ATM withdrawals, foreign exchange and certain annual service fees, as applicable. The fees currently charged in connection with Bitinsist Debit Card: One-time issuance fee 20$, annual fee 20$, purchasing 1% min 0,5$, atm withdrawal 4% min 3,8$, forign exchange purchase currency conversion 5%, pin-change 5$, card replacement 20$, DHL-express card replacement 98$. Please note that we are not responsible for certain third party fees associated with the Bitinsist Debit Card and such fees are subject to change from time to time. Bitinsist reserves the right to charge additional fees or to change the amount of fees.

Bitcoin Transactions. Bitinsist can not and does not guarantee the value of bitcoins. You acknowledge and agree that the value of bitcoins is highly volatile and that buying, spending, mining and holding bitcoins involves a high risk. Additionally, the bitcoin consensus network is solely responsible for verifying and confirming proposed transactions that you submit via our services, and Bitinsist can not and does not confirm, cancel, or reverse bitcoin-to-bitcoin transactions, other than confirmation of the bitcoin network’s completion of a transaction. The bitcoin network is operated by a decentralized network of independent third parties. Once a transaction request has been submitted to the bitcoin network via our services, the bitcoin network will automatically complete or reject the request and you will not be able to cancel or otherwise modify your transaction request. You acknowledge and agree that Bitinsist is not responsible for any errors or omissions that you make in connection with any bitcoin transaction via our services. Bitinsist has no control over the bitcoin network and therefore cannot and does not ensure that any transaction request you submit via our services will be completed. You acknowledge and agree that the transaction requests you submit via our services may not be completed, or may be substantially delayed, by the bitcoin network. When you complete a transaction request via our services, you authorize us to submit your transaction request to the bitcoin network in accordance with the instructions you provide via our services.

Wallet Address and Private Key. When you create an account, our services generate and store a cryptographic private and public key pair that you may use to send and receive bitcoins via the bitcoin network. The public key generated by our services serves as your bitcoin wallet address, and may be shared with the bitcoin network and with others to complete bitcoin transactions. The private key uniquely matches the wallet address and must be used in connection with the wallet address to authorize the transfer of bitcoins from or to that wallet address.

Custody of Bitcoins. Bitinsist does not obtain any legal or beneficial right, title or interest in your bitcoins that you store in your wallet.

Ownership of Intellectual Property Rights. Bitinsist retain all right, title, and interest (including all copyright, trademark, patent, trade secrets, and all other intellectual property rights) in our services and all content on our services, including our trademarks, service marks, designs, logos, URLs, and trade names that are displayed on our service. You can have a limited access to these materials while you are a user of our services and while you are registered as our client.It is terminated when you end using our services.You may not use, copy or retransmit anything on our website without our permission. We reserve all rights not expressly granted herein.

Authorized Uses of Our Services. You are permitted to use our services, only as we have authorized. You are responsible for ensuring that your personal information in your account profile is current and correct, including your email address and mobile phone number. You are also responsible for maintaining adequate security, control and confidentiality of your account information, including any passwords andany other activity occurring within your account. The loss or compromise of this information may result in unauthorized access of your account, which may result in loss or theft of any bitcoins held in your account. You are responsible for immediately notifying us of any unauthorized use of your password or account or any other breach of security, and ensuring that you exit from your account at the end of each session when accessing your Bitinsist account. We have no responsibility for any loss that you suffer as a result of failing to comply with this section or your failure to follow or act on any notices or alerts that we may send to you.

Using SMS and Text. To use our Bitinsist web page or app you must provide a valid mobile phone number. This number is used as part of the authentication process. As part of using our services, you are agreeing to receive SMS/text messages from us. Please note that while we do not charge you for SMS/text messages, your mobile carrier’s standard messaging rates will apply. Failure to provide a valid mobile phone number may result in restriction of your use of our services. If we suspect that your mobile number is invalid or that you are using any fraudulent services to circumvent the requirement to provide a valid mobile phone number, Bitinsist may suspend or otherwise restrict your use of our web page.

Accurate Information and Registration Requirements. Bitinsist reserves the right not to open accounts and to temporarily or permanently suspend accounts, including where required or recommended by applicable governmental, regulatory or law enforcement requirements, including where you fail to provide sufficient information on demand. Our services are for the use only of the registered account holder. You agree that the information you provide to Bitinsist during the account creation and any subsequent identity verification processes is accurate and complete, and will be updated as necessary.

Restricted Activities. In connection with your use of Bitinsist services, and your interactions with other users, and third parties you will not violate or assist any party in violating any law, statute, ordinance, regulation or any rule of any self-regulatory or similar organization of which you are or are required to be a member (for example, those laws, rules, or regulations governing financial services, controlled substances, unlawful gambling or consumer protections). You will not take part in a transaction which involves the proceeds of any unlawful activity. You will not defraud or attempt to defraud Bitinsist or Bitinsist users or clients. You will not take any action that imposes an unreasonable or disproportionately large load on our infrastructure, or detrimentally interfere with, intercept, or expropriate any system, data, or information or defame, abuse, harass, stalk, threaten or otherwise violate or infringe the legal rights (such as, but not limited to, rights of privacy, publicity and intellectual property) of others.

Limitation of Liability. in no event will we, our licensors, service providers or subcontractors (if any) be liable for any indirect, special, incidental, punitive or consequential damages (including, without limitation, lost profits, loss of use, loss of data or loss of goodwill), arising out of or in connection with these terms of use, or the performance or operation of our services, your access to, display of, use of the services, or with delay or inability to access, display or use the services, any computer viruses, information, software, linked sites, products or services obtained through the services, or the act or omission of any business using our services or other third party, whether such liability arises from any claim based upon breach of contract, breach of warranty, tort (including negligence), product liability or otherwise, and whether or not we, our licensors, service providers or subcontractors have been advised of the possibility of such damages. in no event will the aggregate liability of Bitinsist, our licensors, service providers, or subcontractors for any loss or damage that arises out of, or is connected with, any of the occurrences described above exceed, the greater of $10. The limitation of liability reflects the allocation of risk between the parties. The limitations specified in this section will survive and apply even if any limited remedy specified in these Terms is found to have failed of its essential purpose. The limitations of liability provided in these Terms inure to the benefit of us, our licensors, service providers and subcontractors. some jurisdictions do not allow certain warranty disclaimers or limitations on liability. only disclaimers or limitations that are lawful in the applicable jurisdiction will apply to you and our liability will be limited to the maximum extent permitted by law. nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence or fraud or fraudulent misrepresentation or breach of the terms or any other liability to the extent that the law prevents the exclusion or limitation of such liability breach of statutory duty, or otherwise, arising under or in connection with our web page or services for any loss of profits, sales, business, or revenue or any loss or corruption of data, information or software or any loss of business opportunity or any loss of anticipated savings or any loss of goodwill; or any indirect or consequential loss.

PRIVACY

By visiting www.bitinsist.com or our Bitinsist app, you are accepting the legal terms and privacy. This privacy policy has been compiled to better serve those who are concerned with how their 'Personally identifiable information' (PII) is being used online. PII, as used in US privacy law and information security, is information that can be used on its own or with other information to identify, contact, or locate a single person, or to identify an individual in context. Please read our privacy policy carefully to get a clear understanding of how we collect, use, protect or otherwise handle your Personally Identifiable Information in accordance with our web page.

Normally we do not collect information from visitors of our site. We collect information from you only when you register on our web page, place an order, respond to a survey, fill out a form or enter information on our web page.

We collect information that your browser sends whenever you visit our web page if you are registered. This may include information such as your computer's IP address, browser type, browser version, the time and date of your visit, the time spent on our pages etc. We may use third party services such as Google Analytics that collect, monitor and analyse this type of information in order to increase our service's functionality. Bitinsist has the right to delete all registration that provide justified incorrect details. We have no responsibility or liabilty for third party links because they have their own privacy policy.

When it comes to the collection of personal information from children under 13, the Children's Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, the nation's consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children's privacy and safety online. We do not specifically market to children under 13.
